Q. - What are the statutory bases of the programs administered by the Department of Real Estate?

A. - The licensing and regulation of Brokers and Salespersons are covered by Business and Professions Code Sections 10000 Graphic:  Denotes a PDF document , et seq.  The Subdivided Lands Law, which governs the offering of new residential subdivisions is located in Section 11000 Graphic:  Denotes a PDF document , et seq, of the Business and Professions Code.  The Real Estate Commissioner has the authority to adopt Regulations Graphic:  Denotes a PDF document  to implement these statutes.


Q. - How can I access California statutes?

A. -  The Department publishes the Real Estate Law each year on the DRE Web site and as a book and CD (submit a Publications Request (RE 350) Graphic:  Denotes a PDF document to order). California statutes are also available on the Internet at http://www.leginfo.ca.gov/calaw.html. Public libraries may also have law books available.


Q. - Where can I find the legal requirements for the Seller's Transfer Disclosure Statement (TDS)?
